The formalism and the skepticism are theoretical and ideological viewpoints that permeate the practical and theoretical common sense of the Law. From the paradigmatic study of the case in which the Brazilian Supreme Court has interpreted in harmony with the Constitution to the Article 1723 of the Civil Code recognizing the stable union of the same sex people, we will discuss the tension between these two positions, in a critical investigation of the dogmatic and juridical practice.
